Copyright Infringement

This website is hosted in the United States of America and therefore falls under the jurisdiction of the United States Government.

The United States Congress enacted The Digital Millennium Copyright Act, more commonly referred to as the DMCA, which was signed into law on October 28, 1998. The DMCA had as its primary purpose the goal of updating United States copyright laws with an eye toward making them more relevant and flexible given the ever changing digital information climate.

17 U.S.C. § 512(c) limits the liability of service providers for infringing material on websites hosted on their systems. Service Providers are eligible for the limitation on liability when they do not have actual knowledge of ongoing copyright infringement, are not aware of facts or circumstances surrounding ongoing copyright infringement, or upon gaining such knowledge the Service Provider responds expeditiously to take the material down or block access to it.

§ 512(c) establishes the procedures for proper notification to a Service Provider should you feel that your copyrighted material has been misappropriated and there is ongoing copyright infringement by someone using our services. Under these so-called notice and takedown procedures a copyright owner submits a notification under penalty of perjury, including a list of specified elements, to our designated agent. Failure to comply with the statutory requirements means that the notification is defective. If, upon receiving a proper notification, the service provider promptly removes or blocks access to the material identified in the notification, the provider is exempt from monetary liability.

We respect the intellectual property rights of others and expect our players and the users of our services to do the same. If you believe that your copyrighted work has been copied or used in a manner that constitutes copyright infringement, you may notify our copyright agent as set forth below.

Please be aware that to be effective, your copyright infringement notification must comply with the Digital Millennium Copyright Act ("DMCA"). You are encouraged to review 17 U.S.C. Sec. 512(c)(3) of the DMCA or consult with an attorney prior to sending a notice hereunder.

To file a copyright infringement notice, you will need to send a written communication that includes the following:
• the date on which you viewed the infringing content
• the full url (e.g. http://www.epicgamesnetwork.org/link/to/content/) and title of the page on which the copyrighted materials appear (if applicable)
• identification of the copyrighted work claimed to have been infringed
• identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material
• your real name and contact information (address, phone, and email)
• the name of the organization you represent (if applicable)
• the name of the person (or organization) that holds the copyright being infringed upon
• your signature or, if sent digitally, a legally acceptable digital alternative
• a good faith statement that use of the copyrighted materials as described in the notice is not authorized by the copyright owner, its agent, or the law
• a statement swearing, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed

Before submitting your request, please consider the following:
• Providing inaccurate or false information in a DMCA takedown notice is considered a felony.
• The DMCA provides that you may be liable for damages (including costs and attorney fees) if you knowingly misrepresent that material or activity is infringing.
• The information provided in your copyright information notice may be provided to the person responsible for the allegedly infringing material.
